What Is the EU Consumer Credit Directive 2023/2225?

Directive (EU) 2023/2225, commonly called CCD2, is the revised EU framework governing covered consumer credit agreements. It modernises scope, information, creditworthiness and consumer-rights requirements. It entered into force in November 2023, but Member States must apply their national implementing measures from 20 November 2026. The applicable national law and transitional provisions remain decisive.

What CCD2 is and why it replaces the earlier framework

Directive (EU) 2023/2225 was adopted by the European Parliament and Council on 18 October 2023 and published in the Official Journal on 30 October 2023. It revises the EU rules governing credit agreements for consumers and repeals Directive 2008/48/EC with effect from 20 November 2026, while retaining transitional provisions. CCD2 is a directive, not an identical directly applicable code of lender procedures in every Member State. National legislation gives effect to the harmonised framework. Businesses must identify the actual law governing their products and customers, not rely on an EU-level summary alone. The Directive responds to changes in consumer credit markets, including digital acquisition and new forms of short-duration finance.

The products and businesses the Directive can affect

The scope assessment begins with Article 2, the Article 3 definitions and the relevant national implementing provisions. Covered credit may involve a bank, non-bank creditor, digital lender or credit intermediary. Some previously excluded or differently treated smaller-value and short-term arrangements fall within the revised framework, but specific exclusions and national options still matter. Supplier deferred payment and certain hiring or leasing structures require examination against their detailed conditions. The brand used in marketing does not decide whether an agreement is regulated. Record who grants or promises credit, who arranges it, the consumer's purpose, contractual charges and repayment obligations, and any legally material third-party involvement before making a classification.

Advertising and information before an agreement

CCD2 contains requirements affecting advertising, pre-contract information and adequate explanations. Article 7 concerns advertising and Article 8 sets standard information requirements for relevant advertisements, subject to the Directive's conditions. Its pre-contractual provisions seek to give consumers information about the proposed agreement before they are bound. Operational design should check the exact information, format, timing, delivery medium and exceptions applicable under national law. A firm cannot establish compliance only by approving a document template. For digital journeys, the display, timing, device experience and version delivered to the consumer can matter. Marketing, intermediaries and creditors need a clear allocation of tasks, but legal accountability follows the legislation rather than commercial contracts alone.

Creditworthiness and responsible lending obligations

Article 18 addresses the assessment of the consumer's creditworthiness, and related provisions govern aspects of information and decision-making. The regulatory purpose is not just to limit the creditor's loss exposure. A firm should distinguish its commercial default-risk model from the legal tests and consumer-protection obligations that apply. Relevant information, proportionality, decisions and evidence require examination under the operative national provisions. Where assessment processes use automation, separate the duties arising under consumer credit law from other applicable data-protection and technology rules. A positive score or low predicted loss does not demonstrate that each required assessment has occurred. Review manual decisions, overrides and changed loan amounts as well as the standard digital application journey.

Agreement terms, servicing and consumer rights

CCD2 addresses matters beyond origination, including the form and content of credit agreements, withdrawal, early repayment, certain open-end arrangements and treatment of consumers facing repayment difficulty. Requirements are distributed across separate articles and may not apply identically to every agreement. Product teams should map each applicable obligation to the customer journey from advertising through application, signature, repayment, arrears and closure. For example, a right to early repayment needs a workable servicing route rather than only contractual wording. Record who can handle a request, the calculation or response used, customer communications and relevant evidence. Distinguish existing agreements from new ones when applying the Article 47 transition.

The key dates do not mean the same thing

CCD2 entered into force on 19 November 2023 under its entry-into-force provision. Article 48 required Member States to adopt and publish transposing measures by 20 November 2025. Those national measures must apply from 20 November 2026. Under Article 47, Directive 2008/48/EC is repealed from the same date, but it continues to apply to agreements existing on that date until termination, subject to express exceptions for specified CCD2 provisions affecting existing open-end agreements. These are distinct legal events. An adopted directive can be in force before its new domestic lending requirements become applicable. Firms should inspect published national instruments, commencement rules, specific options and supervisory material.

A defensible first compliance review

Build an inventory of consumer credit products, funding entities, intermediaries, jurisdictions and existing agreement populations. For each product, identify the current national regime, the implementing law, potential CCD2 scope changes and the effective or application date. Examine the actual advertising journey, pre-contract information, assessment rules, agreement version and servicing controls. Record authoritative source URLs and exact article references, not just secondary summaries. Assign changes to control owners, test exceptional journeys and preserve implementation evidence. If a national status or exclusion is unresolved, label it as pending instead of treating an unverified interpretation as binding law. Review the inventory after a statutory amendment, regulator communication, court decision or product redesign.

Frequently asked questions

When do CCD2 implementing measures apply?

Member States must apply the measures from 20 November 2026, following the 20 November 2025 transposition deadline.

Does CCD2 automatically replace the old rules for existing agreements?

No. Article 47 preserves Directive 2008/48/EC for existing agreements until termination, subject to specified CCD2 provisions for existing open-end agreements.

Is the EU Directive the complete national compliance rulebook?

No. Member State implementing laws, applicable national options, competent authority guidance and transitions must be checked.
