October and November 2023: adoption and entry into force
The European Parliament and Council adopted Directive (EU) 2023/2225 on 18 October 2023. Publication in the Official Journal followed on 30 October 2023. Article 49 provides entry into force on the twentieth day following publication, which EUR-Lex records as 19 November 2023. Entry into force means the Directive forms part of the EU legal order and creates requirements directed to Member States. It does not mean every operational duty in the new framework began applying to consumer credit agreements immediately in 2023. The implementation timetable was deliberately longer to permit national legislation and changes to lenders' systems, documents and practices. Always distinguish the legislative milestone from the later national application date.
20 November 2025: national transposition deadline
Article 48 required Member States to adopt and publish the measures needed to comply with CCD2 by 20 November 2025 and communicate the text to the Commission. That was a legal deadline for national implementation, not the scheduled date on which those measures began applying to all covered lending. A national instrument can be published before its substantive provisions commence. Firm-level compliance inventories should therefore contain separate fields for enactment, publication, commencement and application. The EUR-Lex national transposition measures facility helps identify notified instruments, but research of the actual national legislative text remains necessary. Do not infer that every possible product and national option has been completely analysed merely because a country has notified a measure.
20 November 2026: application and repeal
The central implementation milestone is 20 November 2026. Article 48 requires Member States to apply national CCD2 measures from that date, and Article 47 repeals Directive 2008/48/EC with effect from that date. As of 12 October 2026, this application date has not yet arrived. Compliance statements should avoid wording that assumes CCD2 has already displaced all current national requirements. For new originations after the date, firms must identify the relevant domestic measures, agreement coverage and any lawful exclusions. Advertising, disclosures, creditworthiness, agreements and servicing systems may need changes that are ready before customer journeys switch over. The date is common at EU level, but operational conclusions depend on each country's implementing instrument.
Article 47: existing agreements do not all switch regimes
Article 47 states that Directive 2008/48/EC continues to apply to credit agreements existing on 20 November 2026 until termination, notwithstanding its repeal. It then specifies CCD2 provisions applying to open-end credit agreements already existing on that date: Articles 23 and 24; the second sentence of Article 25(1); Article 25(2); and Articles 28 and 39. This is not a blanket conversion of every existing agreement to the new Directive, nor an unconditional exemption for every legacy account. Product teams should distinguish closed-end, open-end and newly concluded agreements and identify the exact transitional rule. Any national implementation detail must also be reviewed before deciding which controls govern a particular population.
After November 2026: supervision, interpretation and review
The start of application is not the end of implementation work. National supervisors may publish guidance, courts may interpret provisions and businesses may discover defects in transitional servicing or digital journeys. Directive Article 46 provides for later evaluation, including a report on the application and effectiveness of the Directive by 20 November 2029, subject to its detailed terms. Different provisions may contain other review or implementation milestones. Do not describe such future evaluations as immediate changes in duties. Record whether each update is legislation, guidance, enforcement action, judicial interpretation or consultation. Control owners should track official sources and relate a change to affected products, processes and agreements rather than treating every publication as universally applicable.
Build a transition calendar by product and country
For every Member State where credit is provided or arranged, record the national instrument, status, dates, competent authority, responsible legal entity and affected products. Link current and future controls to advertising, applications, creditworthiness, agreement generation, arrears and rights handling. Distinguish new lending from accounts existing before 20 November 2026. Include owners, release milestones, testing evidence and unresolved questions. A single EU rollout date does not resolve different national options, technology dependencies or the content of a specific local instrument. Test in-flight journeys, delayed acceptances, refinancings and manual exceptions. These cases may require a separate legal analysis of when an agreement was formed and which statutory regime governs it.
When to update the published timeline
A credible chronology should have a verification date and clear review triggers. These include publication or amendment of national implementing legislation, regulator implementation guidance, judicial decisions, changes to Article 47 interpretation and the arrival of the application date itself. Maintain historical versions so readers can distinguish what was known before the cutover from what applied afterward. Do not replace current law with a proposed amendment or interpret an unimplemented proposal as binding. A country-by-country chart should state the exact national source and whether its status was independently checked. The EU timeline is authoritative for the Directive's dates, while the practical legal position of a lender requires current domestic-source verification.
Frequently asked questions
When do CCD2 implementing measures apply?
Member States must apply the measures from 20 November 2026, following the 20 November 2025 transposition deadline.
Does CCD2 automatically replace the old rules for existing agreements?
No. Article 47 preserves Directive 2008/48/EC for existing agreements until termination, subject to specified CCD2 provisions for existing open-end agreements.
Is the EU Directive the complete national compliance rulebook?
No. Member State implementing laws, applicable national options, competent authority guidance and transitions must be checked.
