The application date concerns national CCD2 measures
Article 48 requires Member States to apply their laws, regulations and administrative provisions implementing CCD2 from 20 November 2026. The Directive was adopted and entered into force earlier, and the transposition deadline was 20 November 2025. These distinctions matter operationally. A lender should not present a generic EU summary as the complete rulebook in a specific Member State. It must identify the actual implementing law and its scope, commencement details, any relevant national choices and the competent authority. On 12 October 2026 the new application date remains prospective, so readiness assessments and current compliance reviews must still distinguish the presently applicable domestic consumer-credit regime from the forthcoming one.
Directive 2008/48/EC is repealed, with transition
Article 47 repeals Directive 2008/48/EC with effect from 20 November 2026, but expressly keeps that Directive applicable to credit agreements existing on that date until their termination. It also applies certain CCD2 provisions to existing open-end agreements. Those specified provisions include Articles 23 and 24, the second sentence of Article 25(1), Article 25(2), and Articles 28 and 39. Firms cannot assume either that all pre-existing contracts transfer entirely to CCD2 or that every legacy open-end account stays completely untouched. Build a dated agreement-population inventory and identify legal treatment by contract type and relevant national provision. Review renewals, modifications and refinancings on their own facts.
More products may require a fresh scope classification
The revised scope is a major area of operational change. Article 2 and the defined terms in Article 3 need to be applied to each product, including small-value loans, short-duration arrangements, interest-free credit, deferred payment, overdrafts and relevant forms of buy now, pay later finance. Several previous exclusions are narrowed or altered, but CCD2 contains its own exclusions and national options. A short repayment period or absence of interest does not automatically resolve scope. Determine whether the creditor, merchant or third party provides finance and whether the agreement meets any special conditions. The same brand can operate legally different credit arrangements. Record the source, product facts and review decision rather than marking every deferred-payment journey uniformly in scope.
Advertising and pre-contract journeys require review
CCD2's rules affect advertising information, presentation and pre-contract customer communications for covered agreements. A business should compare existing marketing claims, representative cost information, pre-contract documents and explanations against the relevant national implementing provisions. A compliant template alone is not sufficient if it appears too late, on the wrong page or with outdated product terms. For digital channels, test mobile screens, calculators, interrupted applications and third-party broker journeys. Map which entity supplies required information and retain evidence of how and when the customer received it. The operational transition may involve marketing, compliance, engineering and customer support. Implementing national law, not a generalized list of desired controls, establishes which presentation obligations are legally required.
Creditworthiness and consumer treatment controls
Article 18 establishes requirements for creditworthiness assessments in covered lending, with other provisions relevant to decision-making and consumer interactions. Firms should examine information collection, assessment policy, exceptions and the records needed under the national rules. A commercial default-risk score does not alone demonstrate compliance with legally applicable creditworthiness expectations. Contracting processes should be reviewed for mandatory information and appropriate agreement terms. Servicing arrangements should account for withdrawal, early repayment, open-end credit rules and the treatment of repayment difficulties where relevant. Distinguish firm-designed controls from legal obligations, and test customer journeys involving amended terms, manual overrides or an existing account. Keep legal-source and operational-test records traceable.
Existing agreements and in-flight applications need separate decisions
Agreement populations should be divided into contracts concluded before the application date, new contracts on or after it and cases where an application begins under an old journey but acceptance occurs later. Article 47 is the starting point for existing agreements, not a complete automatic answer for every edge case. Contract formation timing, national implementation and the legal effect of modifications can matter. Open-end agreements deserve specific attention because Article 47 applies selected new provisions to existing contracts of that type. Track the applicable document versions, offer acceptance, customer communications and servicing system rules. Unresolved legal questions should be explicitly assigned to reviewers instead of silently routing every account to one set of terms.
Evidence to retain for the November cutover
Maintain a source-based product inventory, each relevant national law, gap assessments, changed policies, marketing and disclosure versions, testing results, control owners and approval dates. Record how new agreements and legacy accounts are separated in systems. Validate broker integrations and delayed customer journeys as well as ordinary originations. Where a provision is not yet applicable, identify it as forthcoming rather than recording it as current. Monitor national legislation and competent authority communications until and after 20 November 2026. A final implementation sign-off should explain the scope, affected products, evidence and remaining limitations. This provides a reviewable basis for the transition without asserting that every internally suggested document is a statutory requirement.
Frequently asked questions
When do CCD2 implementing measures apply?
Member States must apply the measures from 20 November 2026, following the 20 November 2025 transposition deadline.
Does CCD2 automatically replace the old rules for existing agreements?
No. Article 47 preserves Directive 2008/48/EC for existing agreements until termination, subject to specified CCD2 provisions for existing open-end agreements.
Is the EU Directive the complete national compliance rulebook?
No. Member State implementing laws, applicable national options, competent authority guidance and transitions must be checked.
