Zero-Interest Credit Requirements

A zero-interest credit offer has no stated interest during the specified period, but that does not automatically mean zero borrowing cost, zero APR, or exclusion from consumer credit regulation. The legal analysis depends on mandatory fees, the agreement's terms, the jurisdiction and whether interest is waived or merely deferred.

Zero interest is a pricing description, not a legal exemption

A creditor may offer a loan with no contractual interest or a short promotional period with a zero borrowing rate. Neither fact alone decides whether the arrangement falls outside consumer credit regulation. The product may involve an intermediary, an instalment schedule, compulsory charges, a merchant subsidy, a penalty structure or later interest payments. Each element matters to classification and disclosures. A zero nominal interest rate also does not always mean a zero annual percentage rate, because legally included charges can raise the cost measure. The compliance record should identify the actual money received, repayment schedule, fee obligations and any condition that causes interest to become payable. Advertisements that say free credit need testing against the full customer journey, not just the rate configured in the pricing engine.

Differentiate waived interest from deferred interest

A genuinely interest-free period means the consumer cannot become liable for interest attributable to that period under the relevant terms. Deferred interest is different: interest can accrue from the original transaction date and become payable if the customer fails to pay the required balance by the deadline. In US open-end credit advertising, Regulation Z section 1026.16(h) contains specific rules for deferred-interest or similar offers. Its interpretation distinguishes these offers from true zero-percent APR promotions in which interest from the promotional period cannot later be imposed. Promotional rate disclosures under section 1026.16(g) can also apply. A product team must therefore examine interest accrual fields, statement presentation and the post-deadline logic. Using a zero-interest headline without explaining a conditional deferred-interest consequence can be materially misleading.

What the revised EU framework changes

Directive (EU) 2023/2225 expands the consumer-credit framework and includes provisions relevant to interest-free or low-cost arrangements, with detailed scope qualifications and exclusions. A merchant's deferred payment for goods or services cannot be treated identically to third-party financing merely because both are described as pay later. The analysis should identify who grants credit, whether another creditor participates, when payment becomes due, and whether charges are payable. Member States had to adopt and publish transposition measures by 20 November 2025; the general application date is 20 November 2026. Earlier national consumer credit laws remain relevant before the new measures apply, as do the Directive's transition provisions. A creditor should confirm the national implementing law rather than assuming every zero-interest checkout offer is automatically regulated or automatically exempt across Europe.

Assess compulsory fees and later rate changes

A product can charge no interest but impose mandatory setup, account, intermediary or service fees. Whether those charges form part of the regulated total cost of credit or finance charge depends on the jurisdiction and their characteristics. Optional services require a separate analysis of genuine choice and marketed terms. If an initial zero rate changes to a standard rate after a stated period, disclosures and advertising should explain the timing and subsequent pricing as required by the applicable law. A conditional promotion may also introduce default or deferred-interest consequences. Separate the nominal interest field from the statutory APR, account charges and total amount payable. Do not describe an offer as entirely cost-free merely because a particular finance-charge calculation excludes one category of fee.

US and UK treatment requires product-specific checks

In the United States, Regulation Z requirements differ for open-end credit, closed-end instalment credit and mortgages. Sections 1026.16 and 1026.24 govern different advertising contexts, and the creditor must identify the relevant subsection before approving a zero-percent claim. Other federal or state laws can be material. In the United Kingdom, FCA consumer credit financial promotion rules and UK statutory rules should be reviewed independently of the new EU Directive. A statement such as no interest does not displace a requirement to present a representative APR where that obligation is triggered. The advertisement should communicate limitations and conditions in a way compatible with applicable prominence standards. Review claims used on marketplace listings, social advertising and merchant checkout screens as well as creditor-owned pages.

Controls for zero-interest customer journeys

Test the offer from advertisement to account closure. Record the rate, promotional duration, mandatory fees, credit provider, payment schedule, post-promotion pricing and whether accrued interest can later be imposed. Run scenarios for full repayment by the deadline, missed payments, partial repayments, returns, cancellations and late settlement. Check that the amount and dates presented to the consumer agree with the generated agreement and servicing configuration. Preserve versions of advertisements and disclosure documents alongside pricing-engine inputs and consent records. Where a creditor relies on a legal scope exclusion, maintain a written product-and-jurisdiction assessment with its source, interpretation and review date. Revisit that assessment after fee changes, intermediary changes or national transposition developments.

Frequently asked questions

No. Legally included charges and the relevant calculation method can produce a nonzero APR.

Are UK representative APR rules the same as US rules?

No. FCA CONC rules differ from US Regulation Z advertising provisions.

When do revised CCD2 national measures generally apply?

From 20 November 2026, subject to applicable national law and transitional provisions.
