Start with the borrower and credit agreement
Consumer credit classification requires identifying the borrower, intended purpose, legal entity granting credit, agreement form and relevant jurisdiction. Consumer loans can support household spending or personal needs, while business borrowing can be governed differently. A product described as personal, instalment or short-term is not automatically covered by one particular regulatory framework. Contracts, repayment conditions, charges and exclusions matter.
Different products engage different rules
Personal loans frequently provide a fixed sum with a defined repayment obligation. Instalment lending describes a repayment schedule rather than one uniform legal category. Revolving accounts, overdrafts, credit cards, supplier deferred payments and third-party retail finance can be subject to different provisions. Security over property, optional acquisition rights or an intermediary's role may further affect scope. Document these features before applying disclosure or creditworthiness controls.
Jurisdiction and application dates
Regulation Z in the United States uses the primary personal, family or household purpose of consumer credit, alongside creditor and transaction definitions. EU rules are shaped by Directive (EU) 2023/2225 and national implementing laws, whose main application date is 20 November 2026. UK consumer credit uses a separate statutory and FCA Handbook framework. Do not merge these systems into one generic legal rule.
Build a reusable product compliance inventory
Maintain an inventory linking the agreement, consumer purpose, creditor, country and key contractual terms to primary legal provisions, exemptions, operational owners and evidence. Review advertising, creditworthiness, information, agreement and servicing responsibilities for each covered product. Preserve versions and review decisions when product terms, finance partners, customer groups or laws change. Scope uncertainty should be escalated rather than hidden behind a broad product label.
