SECCI Requirements Explained

SECCI requirements depend first on the law governing the actual consumer credit agreement.

Determine the governing SECCI rules

SECCI requirements depend first on the law governing the actual consumer credit agreement. For many covered EU agreements, Article 5 and Annex II of Directive 2008/48/EC underpin the current national approach. Directive (EU) 2023/2225 revises the information obligations in Article 10 and the Annex I form, with implementing measures generally applicable from 20 November 2026. The two instruments should not be presented as one unchanged checklist. The business should document its market, product, creditor, intermediary role, agreement type and application date. If the agreement falls under a specialised regime or exclusion, the required document may differ. Article 11 of CCD2 uses the European Consumer Credit Information form in Annex II for certain agreements, not the ordinary SECCI form.

Populate identification and product fields accurately

The creditor's identity and contact information, together with details of any relevant credit intermediary, should match the contracting and distribution arrangements. Describe the type of credit, total amount, conditions for drawdown, duration and other product features required by the governing form. Deferred payment financing of goods or services may require identifying the financed item and its cash price. A supplier's branding should not hide the identity of a third-party lender. A field should not be omitted merely because it is hard to collect from the checkout system. Conversely, not every optional field is necessarily relevant to every product. Follow the form's instructions and national rules for how non-applicable entries are handled, instead of inventing a different abbreviated form.

Reconcile borrowing costs and repayment disclosures

The form's figures should reflect the actual offer. They may include the borrowing rate and whether it is fixed or variable, the APR, total amount payable, repayment instalments and timing, and additional relevant costs. An APR engine should apply the statutory assumptions to the correct data and preserve a reproducible calculation. If access to an account or ancillary service is compulsory to obtain the promoted credit terms, assess its treatment under the applicable legal definition of total cost. Certain drawdown methods or variable terms can require additional explanation. Do not display an illustrative low rate as the binding offer if eligibility or pricing has changed. Compare the final agreement schedule against the information handed to the consumer before commitment.

Include default information and consumer rights

A complete SECCI implementation must not focus only on rates and term length. Depending on the applicable form, relevant items include late-payment interest and charges, the consequences of missed payments, requirements for guarantees or compulsory ancillary services, withdrawal rights and early repayment rights, together with permitted compensation where relevant. Particular types of credit can require further information. The precise formulation should follow the governing law, not a generic customer-service script. A standard form that correctly describes the numerical instalments but states the wrong withdrawal procedure is still defective. Legal and servicing teams should confirm that the disclosed rights can be carried out through the organisation's actual customer contact and processing arrangements.

Apply the required format, priority and timing

Directive 2008/48/EC provides for the Annex II SECCI form in good time before the consumer is bound, on paper or another durable medium. CCD2 Article 10 introduces specific prominence rules for important items in the Annex I form and requires the consumer to receive the information in good time, with a durable medium chosen by the consumer. Article 10 also deals with a withdrawal reminder where pre-contract information is provided less than one day before the consumer becomes bound. These rules should be translated into a clearly defined journey event and document delivery mechanism. A draft PDF in a back-office system is not evidence that the consumer actually received it. Check accessibility, readability and retention on mobile devices.

Validate outputs, versions and delivery logs

A field-level control matrix can identify each legal requirement, source system, calculation rule, validation check and content owner. Automated tests should include zero-interest credit, variable rates, fees, amended borrowing amounts, promotional terms, different intermediary identities and repayments falling on irregular dates. Compare the form against the agreement the consumer ultimately accepts. Keep immutable versions of issued documents and a delivery log sufficient to investigate complaints or supervisory requests, while observing privacy and records-retention law. A national legal reviewer should approve the template selection and changes that affect mandatory wording. Important review triggers include implementation amendments, court decisions, regulator guidance, pricing updates and changes to the electronic customer journey. No single SECCI template should be treated as automatically compliant in every EU Member State.

Frequently asked questions

Is the same disclosure document required for every EU credit product?

No. Product scope, agreement classification and applicable national law determine the prescribed form and its contents.

When does CCD2 replace the previous framework?

Member States must generally apply their CCD2 implementing measures from 20 November 2026, subject to the applicable transitional provisions.

Is providing a form the same as giving adequate explanations?

No. Information delivery and the legally required explanations are distinct obligations and should be assessed separately.

Operating frameworks on this page are editorial suggestions. Apply the legal text and current national requirements to the actual product facts; these methods do not determine compliance.
