Why an advertising example must be representative
A representative example explains the cost of a credit agreement using coherent assumptions rather than a collection of attractive numbers taken from different product versions. Under Article 4 of Directive 2008/48/EC, relevant standard information is specified by means of a representative example when the advertising-cost trigger applies. Article 8 of Directive (EU) 2023/2225 retains the representative-example approach within its updated framework. The legal obligations arise through the applicable framework and national implementation. A campaign should not choose a rare introductory rate or unusually favourable borrower circumstances while implying those terms are broadly available. The goal is meaningful comparison, and the example must be checked against actual lending terms.
Build one internally consistent financing scenario
Start with the total amount of credit and identify the actual term, repayment pattern, applicable borrowing rate, costs and any conditions affecting the advertised agreement. For deferred-payment purchase finance, cash price and advance payment may be relevant. Calculate the total amount payable and APR using the prescribed assumptions rather than mixing monthly instalments from one offer with an APR from another. Verify that rounding does not create a materially contradictory set of amounts. If a product has multiple interest-rate bands, define and document the assumptions that make the chosen example representative under the applicable law. Avoid marketing selections made solely because they minimise the quoted APR. Quality assurance should independently reproduce the displayed figures.
Understand the disclosures that the example carries
An example is not a standalone marketing decoration. Article 8 of CCD2 provides for standard information when an advertisement includes an interest rate or numerical figures relating to credit cost. The prescribed items can include the borrowing rate, total credit amount, APR, duration, total payable and instalments, with additional specifics for particular arrangements. Ancillary-service requirements may also affect the information supplied. The earlier Article 4 framework must be checked for currently applicable national requirements. This makes it important to identify whether a particular promotional communication is subject to the standard-information trigger before selecting the example. The exact wording, ordering and permitted medium-specific modifications must then follow the relevant law.
Make the example match the likely offer
A supposedly representative example becomes unreliable when it relies on loan sizes few customers can obtain or pricing conditions not clearly disclosed. A compliance reviewer should compare the example with the firm’s current product catalogue, eligibility criteria, pricing data and usual marketing audience. Where a headline features a particularly low rate, distinguish that offer from the representative example and assess the overall impression for fairness and clarity. A correct mathematical APR is not enough if the combined presentation creates false expectations about availability. No single statistical percentage can be assumed to define representativeness in every Member State; verify the applicable domestic rule and supervisory interpretation.
Special care for apps, affiliates and comparison services
Representative information may be lost when advertisements are reformatted into carousels, comparison cards or limited-character placements. Advertisers should test the published page at realistic device sizes and with accessibility features enabled. A comparison site may pull the APR automatically while leaving the underlying term or instalment amount stale. Affiliate teams need a process for replacing outdated creative, withdrawing expired offers and confirming approved examples across channel partners. Preserve information on which version was displayed, when and for what product. An example that is complete on a linked PDF does not necessarily make the advertisement itself compliant where the law requires the information in the promotion.
Audit the calculation and revisit the legal position
Maintain a source-of-truth calculation worksheet or controlled pricing engine, inputs for each example, independent check evidence and a record of the creative approved for publication. Trigger reassessment when fees, interest rates, merchant subsidies, repayment intervals or borrower eligibility change. A material increase in credit costs should not leave a previous representative example online simply because the image still renders correctly. National implementation of CCD2, regulator guidance and enforcement developments may change the applicable operating detail. Record 20 November 2026 as the general application date for the new implementing measures and distinguish that future date from the requirements already operative under existing national consumer credit law. When an example is derived from live pricing data, testing should include edge cases at the boundary of a pricing tier and offers where ancillary charges change. The compliance record should show the same inputs can reproduce every amount appearing to consumers. If a distribution partner uses the data through an API or feed, assign responsibility for refresh frequency and removal of superseded terms. Keep a clear distinction between the model that calculates figures and the judgement that those figures represent a lawful advertisement.
