What counts as an ancillary service
An ancillary service is offered with a credit agreement but is conceptually distinct from providing the credit itself. Examples can include payment-protection insurance, credit-related assistance, monitoring services or a subscription sold at the application stage. The revised EU Consumer Credit Directive defines an ancillary service and separately addresses its cost within the total cost of credit. A product sold by another legal entity can still be relevant to the credit arrangement. The compliance question is not simply whether a second contract exists; it is whether the service is required for the credit or the terms marketed, and how the law treats the charge. Firms should identify the party offering the service, the consumer's selection point and whether pricing or approval changes when it is declined.
When optionality changes credit cost
Directive (EU) 2023/2225 states that ancillary-service costs, particularly insurance premiums, are included in total cost where a service contract must be concluded to obtain credit or to obtain it on marketed terms. A service that consumers may genuinely refuse while obtaining the same advertised terms will require a different assessment from a service bundled into every approved application. Optional in a product description is not decisive. Evidence might include a working opt-out, unchanged credit decision criteria, unchanged pricing, a separate acceptance record and completed customer-journey tests. Conversely, if the consumer must buy the service for a discounted interest rate, the condition for obtaining the marketed terms may engage the Directive's inclusion rule. Member State implementation must be verified before applying the new national measures from 20 November 2026.
US rules for voluntary insurance and cancellation products
Regulation Z section 1026.4 addresses voluntary credit life, accident, health or loss-of-income insurance premiums and fees for debt cancellation or suspension coverage. Certain exclusions from the finance charge depend on specified conditions, including disclosures and affirmative requests or agreements, which vary with the product type and transaction. The statutory conditions cannot be satisfied merely by a checkbox marked optional in an internal system. Review the required customer-facing statements, election records and premium or fee amounts against the relevant paragraph of section 1026.4 and its official interpretation. Credit-card application disclosure obligations can also differ from closed-end loan requirements. Do not generalise a single insurance exclusion across property insurance, credit protection and other service types.
Consent, presentation and the actual application flow
A digital interface may create an effective condition even where the legal terms say the service is voluntary. Test whether the customer can deselect the product, complete the application and receive the advertised loan without further friction or repricing. Record any preselection, separate consent, price breakdown, decline path and confirmation shown before agreement. An ancillary product attached after credit approval can still affect disclosure or conduct obligations if its purchase is a condition of the offered price. Review the complete channel, including intermediary scripts, checkout integrations and mobile layouts. Service cancellation rules and refund terms should also be documented, since removing a product after origination may not undo an earlier cost-disclosure error. Preserve a dated screen record for material user-journey variations.
Distinguish service charges from non-service costs
A voluntary service payment should not be confused with a default fee, optional payment method charge, compulsory account charge or fee for the underlying credit facility. Each type can fall under a different part of the relevant legal framework. For the UK, review the current total charge for credit legislation and FCA requirements; avoid relying on the EU Directive as though it were UK law. For EU countries, distinguish existing national consumer credit rules from the revised Directive's later application date and any transitional arrangements. For the US, separate finance-charge inclusion from other account-opening and solicitation disclosure requirements. A service price may be excluded from one particular APR computation yet remain a material fee that another consumer-facing disclosure must describe.
Controls for the service catalogue
A defensible product record lists each service's name, provider, benefits, charge, charging period, credit-linked eligibility and opt-in or opt-out conditions. Link those facts to an approved legal classification and rule citation for every relevant jurisdiction. Test the applicant path with service selected and declined, including promotional rates, refunds and renewal situations. The APR calculation engine should receive an explicit legally reviewed inclusion flag, rather than infer treatment from the service name or a checkout component. Audit samples should reproduce the terms actually offered to the consumer and the disclosures provided. Reassess classifications after changes to bundling, third-party arrangements, cross-selling practices, legislation or regulator interpretation. This provides a traceable explanation of why a charge was included or excluded.
Frequently asked questions
Are all fees part of the total cost of credit?
No. The applicable legal definition and the facts of each fee determine inclusion or exclusion.
Are optional services always excluded from APR?
No. Genuine optionality, marketed terms and jurisdiction-specific exclusion conditions must be assessed.
When do the revised EU rules apply?
