Information obligations continue after the contract
Signing a consumer credit agreement does not end the creditor's information duties. The applicable duties vary by product and law. A fixed-term instalment loan, a variable-rate agreement, an overdraft and an open-end facility may trigger different notice and statement requirements. A servicing team should first establish the agreement type, national implementation and whether the right concerns a statement, a change notification, a contract document or another consumer request. Do not imply that every customer is entitled to an identical monthly statement under all credit products. Equally, a payment schedule delivered at origination cannot substitute for later notices that the applicable rules require.
Changes to borrowing rates
Article 11 of Directive 2008/48/EC addresses information about changes in the borrowing rate, generally before the change takes effect, on paper or another durable medium. The notice includes the resulting payment amounts and relevant changes to number or frequency of payments. Article 11 allows a specified periodic-information arrangement for certain changes linked to a publicly available reference rate if the conditions are met. These details make rate changes different from routine promotional messages. Record the previous and new rate, effective date, reference-rate basis, repayment impact, agreement clause, dispatch record and applicable national provision. Avoid assuming that a public website update alone discharges the individual notice requirement.
Information when contractual terms are modified
The consolidated Directive 2008/48/EC includes Article 11a, introduced by later EU amendments, concerning information prior to modifying the terms and conditions of a credit agreement. It describes proposed changes, timing, whether consent is relevant, complaint channels, time limits and the competent authority. Whether and how a particular amendment is permitted remains a distinct question under the contract and national law. A complete operational check must distinguish the right to receive information from the legal power to vary a term. Keep a dated copy of the communication and evidence of the procedure used. The requirements for contract modifications are also addressed by Article 22 of CCD2 in the future national framework.
Overdraft account statements
Article 12 of Directive 2008/48/EC requires regular statements of account for covered overdraft facilities on paper or another durable medium, with specified data such as the statement period, drawdowns, opening and closing balances, payments, borrowing rate and relevant charges. It also addresses notification of increases in borrowing rates or charges. The provision does not create a universal overdraft template for every other credit product. Servicing systems should reconcile transactions, balance dates, the applied rate and the statement generated for the consumer. Missing periods, incorrect values, a stale statement link or an unrecorded rate change can defeat the purpose of timely and understandable information even when the data exists internally.
Open-end agreements and access after origination
Article 13 of the existing Directive separately addresses standard termination and termination of drawdown rights under an open-end agreement, including relevant notification conditions. Consumer requests for copies, payoff information and transaction histories may involve additional national law and contractual or data protection rights. Do not promise that one EU Directive provision resolves all document-access requests. Differentiate information required proactively from material supplied on request. Staff should be able to locate the version of the agreement the customer accepted and explain whether a request concerns legal disclosure, account servicing, access to personal data or a complaint. Each route may have a different deadline or response requirement.
CCD2 information rules from November 2026
Directive (EU) 2023/2225 includes updated contractual, modification, rate-change, overdraft and overrunning provisions, notably Articles 21 to 25. Article 24 requires statements for covered overdraft facilities regularly and at least monthly in the revised framework. National implementing measures generally apply from 20 November 2026, with relevant transitional rules for certain existing open-end agreements. A business should not import the revised monthly statement standard wholesale into its description of present-day law under Directive 2008/48/EC. Map the actual national instrument and date for every product. Retain examples of revised notices and delivery controls before the application date, with sign-off from the responsible legal and servicing teams.
Evidence and information-request controls
A useful information-rights register specifies each trigger, document, delivery method, audience, jurisdiction and evidence record. Triggers may include a variable-rate reset, an agreement modification, a periodic overdraft statement, an open-end facility notice or a customer's document request. Test what happens when an email bounces, a customer changes address, a document is not accessible or a system creates the wrong repayment figure. Review notices for clarity and identify who resolves disputed account data. Make it possible to reproduce what the consumer received rather than displaying only the latest template. This approach supports both routine servicing and later complaints, while leaving national procedural requirements to be assessed under the applicable law.
Frequently asked questions
Do the CCD2 rules already apply in every EU country?
The Directive is adopted but national measures generally apply from 20 November 2026; present law and transitional rules must be checked.
Do rights depend on the type of consumer credit agreement?
Yes. Product scope, creditor role, jurisdiction and legal exemptions determine which obligations and remedies apply.
What should firms retain as evidence?
Keep the agreement version, applicable legal source, consumer communications, decision records and complaint or servicing history as relevant.
