Digital access does not remove consumer credit rights
A credit agreement arranged through an app, embedded checkout, or website may be subject to the same consumer-credit protections as an offline arrangement. The exact requirements depend on the product, parties, governing jurisdiction and legal scope. Digital interfaces can make some consumer interactions easier, but speed does not displace rules governing pre-contract information, creditworthiness, contractual documentation or withdrawal. Under Directive 2008/48/EC, a covered consumer must receive prescribed pre-contract information and contractual content, and Article 14 provides a withdrawal framework. Firms should not assume that a clicked checkbox or successfully completed application proves every separate information obligation was met.
Delivering information on a durable medium
Article 5 of Directive 2008/48/EC addresses pre-contract information on paper or another durable medium, and Article 10 requires covered credit agreements to be drawn up on paper or another durable medium with copies supplied to the parties. A transient pop-up, disappearing banner or page that changes without a retained version may raise questions about compliance with durable-medium requirements. A digital service should map which documents can be retained, reproduced unchanged, and accessed by the relevant consumer. An email attachment, in-app document, or account message may require assessment of the actual technical and legal conditions rather than being assumed sufficient based only on its format.
Explaining the agreement before acceptance
Interface design affects whether key information is presented at the correct stage, with sufficient prominence and enough time for review. Test the journey on mobile and desktop devices, with assistive technology, interrupted connections, and returning users who resume an unfinished application. Store the version of the terms, repayment information and pre-contract disclosure that the individual actually received. Where a credit intermediary operates part of the checkout, confirm the division of responsibilities and the evidence available to the creditor. Avoid pre-ticked acknowledgments or consent patterns that obscure a distinct legal right; assess both the legal form of an acknowledgment and what the user was shown.
Withdrawing and exercising rights after signing
Consumer rights continue after the borrower leaves the application screen. Where Article 14 withdrawal applies under current national implementing law, the lender needs a way to receive and record the consumer's notification and explain any associated payment obligations. A request submitted online should not disappear because the account is closed or the app is removed. Customer service should distinguish withdrawal from early repayment, a merchant refund and a complaint. Dates, notification channels, balances and interest calculations should be retained in a form that can be reconstructed. Consumers may need a different remedy for a linked purchase than for the credit agreement alone.
Automated credit decisions and CCD2 transition
Online applications often use automated inputs or credit scoring, but the legal treatment depends on the role played by automation and the data being processed. GDPR Article 22 supplies safeguards in certain solely automated significant decisions, while Articles 18(8) and 18(9) of CCD2 add creditworthiness-related human-intervention and rejection requirements for the revised national framework. National measures implementing CCD2 are generally scheduled to apply from 20 November 2026. As of October 2026, assess current law separately and document changes required for the new date. An appeals button is not by itself evidence that the legally relevant review rights have been implemented.
Testing a digital-rights control environment
A comprehensive test captures the advertisement, application screens, information supplied, customer acknowledgments, agreement copy, decision outcome, withdrawal route, servicing messages, and records of any complaint. Include error paths: a dropped connection after acceptance, an unsigned contract, an unavailable document link, a wrong currency, and a request routed to the wrong team. Reconcile the displayed APR, repayment figures and personal data with their backend sources. Assign an owner to resolve defects and retain dated evidence of fixes. A usable record should show not only that the system can display a disclosure today, but what the consumer was actually shown when their agreement was made.
Access failures and continuity of rights
Digital delivery should be tested when a borrower loses app access, changes device or email, needs an accessible format or cannot authenticate through the original method. The lender should establish secure alternatives where appropriate without bypassing identity or data-protection controls. Retain immutable evidence of the document version delivered at signing, and record failed transmissions rather than assuming that an upload means receipt. Where a merchant hosts the journey, clarify who captures acknowledgment and responds to consumer-rights requests. Test broken links, interrupted checkout flows, mobile display problems and attempts to withdraw after the app has been deleted. A clear customer-service route is particularly important for consumers trying to distinguish credit withdrawal from refund of an underlying purchase.
Frequently asked questions
Do the revised CCD2 rights already apply everywhere in the EU?
No. CCD2 has been adopted, but Member States must generally apply implementing measures from 20 November 2026. Current national law and transitional provisions must be checked.
Does the same rule apply to every credit product?
No. Product scope, national implementation, contractual facts and applicable exclusions must be assessed.
What should a compliance team record?
Record the agreement, applicable national law, relevant consumer interaction, notices, review decisions and supporting evidence.
