The Consumer Credit Act and national terminology
The Bulgarian Consumer Credit Act, Закон за потребителския кредит, is a core national legal source for consumer-credit contracts, disclosures and relevant borrower protections. Country analysis should use the original Bulgarian statute and consolidated amendments rather than treating a translated heading as binding legal text. The applicability of the law depends on the product and consumer transaction, with potentially separate regimes for housing or mortgage-related lending. A compliance review should establish which entity grants credit, where the consumer resides, what fees and borrowing costs apply and which disclosure forms are legally prescribed. EU CCD2 establishes a revised framework, but the operative requirements at a given date are determined by Bulgarian domestic legislation and valid transitional rules. Do not assume an EU deadline itself supplies every national statutory clause.
Consumer Protection Commission and regulatory roles
Bulgaria's Commission for Consumer Protection, Комисия за защита на потребителите (KZP), is an important public authority for consumer protection. Banking and financial-sector oversight may separately involve the Bulgarian National Bank, Българска народна банка (BNB), depending on the activity and institution. An individual lender should map contract compliance, market conduct, authorisation and financial reporting to the correct bodies and applicable legislation. A consumer complaint about misleading cost information is not identical to the financial regulation of a bank or the operation of the credit database. Check the official authority's current competence and enforcement guidance. Assign responsibility for handling Bulgarian-language customer documentation and complaints without assuming that a single pan-European supervisory process is sufficient.
The Central Credit Register is a distinctive institution
The Bulgarian National Bank operates the Central Credit Register, Централен кредитен регистър (ЦКР). Its official materials describe Ordinance No. 22 and the legal framework governing the register. The register contains information about credit indebtedness reported by relevant institutions, and the BNB provides procedures for eligible access and requests for personal credit information. This is not simply an optional commercial bureau chosen by each lender. Institutions must determine their precise reporting and access duties according to their legal category, the register rules and the applicable dates. From 1 January 2026, BNB materials refer to updated rules for specified participating institutions. Credit-reporting controls should check account identifiers, arrears status and corrections against the current operational instructions.
Creditworthiness and data accuracy
A lender using Central Credit Register information should interpret it alongside other lawfully obtained evidence relevant to repayment ability and affordability under the applicable regime. Registry data may be incomplete, stale or require correction, and does not automatically show every household expenditure or irregular income source. Check when an inquiry is legally appropriate, what the result means, and whether the consumer disputes an entry. Retain assessment evidence and any lawful access or consent record required for the particular purpose. An automated decline should not be defended merely by claiming that the BNB register provided a score. Rules on consumer decision explanations, protection of personal data and rectification should be evaluated separately. A documented correction process is essential where historical arrears or transferred accounts were incorrectly reported.
Bulgarian CCD2 implementation status and dates
Directive (EU) 2023/2225 requires national implementation, with revised rules generally applying from 20 November 2026 subject to transition. For Bulgaria, the precise enacted amendments, commencement provisions, scope of newly covered digital products and available national options require verification against the official Bulgarian legal publications and current regulator material. The BNB's Central Credit Register page is evidence about credit reporting, not proof that the whole CCD2 transposition is in force. Avoid claiming a specifically named new Bulgarian CCD2 law without confirming its official publication. Firms should maintain a national legal-change register identifying which provisions govern loans signed before and after any effective date. Test broker, BNPL and smaller credit products separately instead of assuming all have an identical implementation path.
Operational lender checks in Bulgaria
Build Bulgarian-language disclosures and complaint procedures from the operative Consumer Credit Act and relevant secondary regulations. Confirm that APR, fees and payment illustrations use the correct legally required methodology for the product. Identify which bank or financial institution category the creditor falls within and map associated BNB register duties. Preserve proof of customer information, executed agreement, creditworthiness assessment and changes to rates or repayment terms. When a creditor transfers or services accounts, reconcile registry information and customer notices as required. Review consumer communications for inaccuracies about cancellation, early repayment and debt collection. A local legal and regulatory source register should support every significant rule rather than relying on internal English-language summaries alone.
Example: a credit register discrepancy
Suppose a Bulgarian consumer applies for an instalment loan and the Central Credit Register record still shows an arrears amount already settled with a previous creditor. The lender should follow applicable rules for accessing the information and evaluating the application, while distinguishing the registry entry from a conclusive finding of nonpayment. The borrower may need the reporting institution to correct the underlying data in accordance with the BNB register process. Preserve the disputed information's source and the outcome of any review. Do not invent an informal direct editing right for the lender or treat the central register as the sole affordability assessment. This example is specific to Bulgaria's centralised credit information arrangements.
CCD2 dates and the governing legal question
Directive (EU) 2023/2225 replaces the earlier EU consumer credit framework and requires Member States to transpose the new provisions. The transposition deadline was 20 November 2025, while the revised rules generally become applicable on 20 November 2026, subject to the Directive's transitional arrangements and the domestic implementation in each jurisdiction. A national act may already be enacted in October 2026 without its material rules yet governing new contracts. In every country, establish the actual agreement date, creditor, borrower, product and locally operative legal text before assessing compliance. An EU-level summary is useful for comparison but is not a substitute for the national statute. Record whether the loan is new, an older continuing agreement or a later amendment, because different timing rules can apply.
From application to contract and servicing
A jurisdictional review should cover which consumer products are regulated, what information and advertisements must disclose, how repayment capacity is assessed, what the agreement contains and how consumer withdrawal, repayment and complaints work. National institutions may divide supervision of licensed financial businesses from enforcement of consumer-contract rules. The creditor should assign clear operational responsibility for each relevant phase, including outsourced brokerage and servicing activities. Document the exact national text and effective date behind a control rather than relying on a single pan-European decision rule. Digital application and e-signature journeys must also comply with local language, presentation and delivery duties where applicable. Account modifications and portfolio transfers can create obligations separate from the original agreement.
Cross-border and local implementation controls
An EU lender should not assume that a licence, credit agreement template or APR calculator approved for one Member State automatically satisfies every other market. Host-country consumer rules, applicable conflict-of-law provisions, permitted activities and national supervisory requirements may affect the transaction. Establish where the consumer habitually resides, which entity is the creditor, whether a branch or intermediary acts locally and which country's mandatory rules apply. Maintain local-language customer information and complaints instructions appropriate to the transaction. Monitor domestic publication of amendments, supervisory communications and transitional guidance. A review record should cite the binding national law and official regulator sources, not merely a supplier's generic statement that a document is CCD2 compliant.
Frequently asked questions
Does CCD2 automatically replace local credit law today?
No. The governing obligations depend on the applicable domestic legislation and commencement date.
Does the same authority regulate every aspect of consumer credit?
Not necessarily. Authorisation, consumer protection and credit registers can have distinct responsible bodies.
When do revised CCD2 national requirements generally apply?
From 20 November 2026, subject to national transition.
