Advertising BNPL Products

Advertising buy now pay later credit requires accurate statements about the actual financing structure and the responsible creditor. Whether CCD2 advertising duties apply depends on scope, including the distinction between third-party BNPL and qualifying supplier deferred payment.

Start by classifying the advertised checkout option

Buy now pay later is a marketing label covering legally different arrangements. A merchant might allow a customer to pay later directly, or a separate finance provider might enter into a credit agreement with the customer. The consequences under EU consumer-credit law can differ considerably. CCD2 Article 2 contains exclusions with conditions, including supplier deferred payment, while agreements involving third-party credit may fall within scope even where no interest is charged. An advertisement cannot be classified from its instalment schedule or brand name alone. Record the contractual lender, supplier, payment timing, fees, default terms and jurisdiction before selecting the advertising disclosures.

Exclusions require their precise conditions

Under CCD2 Article 2(2)(h), qualifying supplier deferred-payment arrangements may be excluded if the supplier itself grants time to pay without a third party offering or purchasing the credit, subject to the relevant conditions. The Directive has particular timing conditions and a tighter rule for certain large online suppliers. Those details prevent a blanket conclusion that every interest-free pay-later offer is exempt. Coverage must be verified under the national implementing law and the actual commercial setup. Moreover, an excluded consumer credit arrangement may still face other consumer-protection and misleading-advertising rules. Merchants should avoid describing an exclusion from CCD2 as permission to make unsupported financial claims.

Credit advertising rules may apply at checkout

If the BNPL arrangement is a covered credit agreement, Article 7 of CCD2 provides for fair, clear and non-misleading advertising. Article 8 provides a borrowing-cost warning and cost-triggered standard information, including representative examples in the circumstances specified. A monthly or instalment payment highlighted next to a product price can affect whether the standard-information rules apply. Existing national law derived from Directive 2008/48/EC remains important until the revised national measures become applicable. Check whether the checkout is advertising, pre-contract information or contract formation at each step. A compliant advertisement does not replace the separate disclosure and creditworthiness duties later in the journey.

Claims of free, flexible or instant financing

Common BNPL slogans emphasise convenience and speed. Review whether an offer genuinely carries no compulsory financing charge, whether eligibility depends on creditworthiness assessment and what happens when a payment is missed. A claim of instant approval should not imply that approval is unconditional. A phrase such as 'split into four payments' should match the actual schedule and should not conceal relevant financing fees. CCD2 Article 8 includes mandatory restrictions on certain promotional suggestions and national options for further prohibitions. Optional restrictions must be assessed against each Member State's implementing law, rather than presumed uniform across every EU country.

Divide responsibilities among the participants

A BNPL campaign can be produced by a merchant, platform, payment intermediary, affiliate or creditor. Identify who approves the product terms and who can change the advertisement or payment examples. The consumer might see the merchant's design, but the finance provider's agreement controls the credit relationship. Document what each participant undertakes to verify, and how inaccurate creative is corrected. Merchant partner arrangements are not a substitute for statutory obligations attaching to the actual creditor or credit intermediary. Audit mobile checkout screens and payment selection tools where labels, fees or required warnings can be truncated. Record exact published versions of externally distributed advertisements.

Keep national rules and evidence current

An effective control file records the product classification, parties, country, marketing claim, cost-trigger analysis, warning text, APR and representative example where applicable, and evidence from the live screen. Changes in creditor identity, underwriting, charges, repayment schedules or third-party purchase of receivables can affect legal classification as well as advertising. As of October 2026 the revised CCD2 national measures are scheduled to apply from 20 November 2026; domestic implementation and transitional treatment remain relevant. Firms should therefore review existing law and forthcoming national changes separately. This article concerns regulatory education and does not establish approval for any particular BNPL product or campaign. When a merchant changes checkout vendors or a finance provider changes the entity purchasing receivables, the compliance team should revisit the contract flow rather than copying the old classification. Consumer-facing terminology such as pay in three may mask material differences in creditor identity or fees between markets. Sampling actual transactions helps verify that landing-page promises match pre-contract disclosures and agreements. The review should also cover returns, cancelled orders and late payments, because these events can expose misleading implications in simple payment slogans. Keep a record of which national rules were consulted for each version of the campaign.
